General terms and conditions of sale
Scope
These general terms and conditions of sale apply to all orders and purchases made via the webshop https://re-shop.be/en/
Owner and Application
The seller is re-shop BV, with its registered office at:
Jean Monnet Avenue 1 box A
1800 Vilvoorde
Flemish Brabant
Belgium
Company number: 1039.854.846
These general terms and conditions of sale apply to all offers, orders, and agreements and shall always take precedence over any general or special conditions of the customer, unless expressly agreed otherwise in writing.
The seller reserves the right to amend these general terms and conditions of sale. The most recent version is always applicable and is published on the website.
The protection of personal data is subject to the seller's privacy policy. The use of the website is subject to the applicable disclaimer.
Prices and Discounts
All prices on the website are expressed in euros and, unless stated otherwise, are displayed excluding VAT and any statutory contributions (such as Bebat or Recupel).
For consumers, the total price including VAT is always clearly displayed before finalizing the order, in accordance with applicable legislation.
The prices displayed on the website may depend on the type of user or customer account. Certain professional customers, such as architects, project developers, or other business partners, may gain access to specific pricing conditions or professional rates after logging in with a verified account.
The prices visible to logged-in users may therefore differ from the prices displayed to visitors who are not logged in.
The stated prices exclude any delivery and installation costs. Any additional delivery costs are clearly displayed during the ordering process or on the delivery information page.
For items with multiple options, prices may vary according to dimensions, materials, colors, or other features. The price is automatically adjusted when the desired options are selected.
Promotions are clearly displayed. When a discount is applied, the original reference price is indicated and the reduced price is shown.
Reservation of products
The seller may offer customers the possibility to temporarily reserve certain products.
A reservation means that a product is reserved for the customer for a predetermined period and will not be sold to other customers during that period.
A reservation fee is charged for this reservation. This fee relates to the temporary blocking and storage of the product and is separate from the final purchase price of the product.
The reservation fee will not be offset against any subsequent purchase and is non-refundable, regardless of whether the customer ultimately proceeds to purchase the reserved product.
Upon expiry of the reservation period, the reservation lapses automatically, unless agreed otherwise, and the product may be offered for sale again.
The practical conditions of reservations, including the reservation period and applicable rates, are explained on the reservation info page or on the relevant product page.
During the reservation period, the product remains the property of the seller until a final purchase agreement is concluded.
Right of Withdrawal
The customer has the right to notify the company that they waive the purchase, without payment of a penalty and without giving a reason, within a period of 14 calendar days from the day following the delivery of the good or the conclusion of the service agreement.
In the event of withdrawal, the direct costs of returning the goods shall be borne by the customer, unless expressly agreed otherwise.
The right of withdrawal does not apply in cases provided for by law, including goods made to the customer's specifications or which have a personalized character.
Further details on exercising the right of withdrawal, the practical return procedure, and any exceptions can be found on the warranty and returns page.
Liability
The seller is not liable for indirect damage, such as financial losses on interest or investments, anticipated profits, consequences of a strike, increase in general costs, or other consequential damage.
If possible, the seller will rectify the identified error at its own expense. Without prejudice to the consumer's legal rights, this may, where appropriate, be done without additional compensation.
If the customer wishes to exercise any right to compensation, they must report this within a reasonable period after the occurrence of the seller's alleged error, to the extent permitted by law.
The seller's liability is, to the extent permitted by law, limited to the amount of the order to which the damage relates.
These general terms and conditions do not exclude liability for fraud, intent, gross negligence, death, or personal injury.
Complaints
Complaints regarding delivery or visible defects must be reported within a period of seven working days after delivery, either via email to info@re-shop.be or by registered mail.
This period applies without prejudice to the consumer's legal rights, in particular regarding the legal warranty and non-conformity.
If a complaint is found to be justified, the seller will initially proceed with repair or replacement, in accordance with the applicable legal provisions.
Warranty
The legal warranty applies to our goods, in accordance with applicable consumer legislation. Specifically, the following warranty periods apply:
- New products: 2-year legal warranty, unless otherwise indicated on the product itself.
- Some new products come with a 5-year manufacturer's warranty; this is always clearly stated on the product sheet.
- Second-hand products: a 1-year warranty on the proper functioning of the item, excluding normal wear and tear of fabrics and upholstery, in accordance with legal provisions.
- Refurbished products: 2-year warranty and are treated as new products.
For purchases by consumers, the legal regulations regarding conformity apply, as determined in European Directive (EU) 2019/771 and the corresponding provisions of the Belgian Civil Code.
The seller has the duty to deliver a product that conforms to the agreement. As a consumer, you are entitled to a sound product that is compliant upon delivery and free from defects.
For second-hand goods, the warranty does not apply to defects that were explicitly communicated by the seller and were therefore known to the buyer at the time of purchase.
A product is compliant when it corresponds to the description provided by the seller, the information in advertising, the manual, and the purchase documents (such as the order form), and is suitable for normal use.
What can reasonably be expected depends on the nature of the product (new, refurbished, or second-hand) and its normal service life.
More practical information about warranty and the procedure for a warranty claim can be found on the Warranty and Returns page.
Condition of second-hand and refurbished products
A large part of the range on the website consists of second-hand, refurbished, or circular products. These products may show signs of use inherent to previous use, such as light scratches, discoloration, or wear.
The seller strives to represent the condition of the products as accurately as possible through product descriptions, photos, and any indications of signs of use. Photos serve primarily for illustration and may in certain cases show a representative example of products of similar quality.
When multiple identical products are offered under one product page, the delivered products may deviate slightly from the photos shown, provided they correspond to the described quality and condition of the product.
Normal signs of use inherent to second-hand or refurbished products are not considered a defect or non-conformity, provided the product corresponds to the description and the stated condition of the product.
Force Majeure
The seller is released from its obligations in the event of force majeure. Cases of force majeure always include: fire, technical failures, computer failure, and all situations that seriously impede operations.
If a case of force majeure actually occurs, the seller is released from its obligations, without any obligation to pay compensation, for as long as the cause and consequences of force majeure exist. The obligations thus suspended will be performed again from the moment the consequences or the cause of non-performance disappear.
Applicable Law and Competent Court
This agreement is subject to Belgian law.
For disputes with professional customers, only the courts of the district of the seller's registered office are competent.
For consumers, disputes shall be submitted to the competent court in accordance with mandatory legal provisions.
In the event of a dispute, the consumer may also use the Online Dispute Resolution (ODR) platform of the European Commission:
https://ec.europa.eu/consumers/odr
